Terms of Use

1. The Service

Molly is a service that helps candidates demonstrate their skills and connect with job opportunities. Through Molly, you can:

• Create a profile and upload information such as your CV/résumé.
• Complete AI-assisted interviews and assessments (including aptitude tests, assignments, and video or live interviews).
• Receive a Molly rating — a reusable indication of your demonstrated skill level that you can use when applying for jobs.
• Apply to jobs and share your Molly-rated profile with employers.

We may add, change, or remove features of the Service at any time.

2. Eligibility and accounts

• You must be at least 16 years old to use the Service.
• You must provide accurate, current, and complete information and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must notify us promptly at molly-support@smashtaps.com if you suspect unauthorised use of your account.

3. Interviews, recordings, and AI ratings

• Some interview formats involve recording your audio and video. We record these only with your consent, requested at the point you begin the interview. If you decline, you may be unable to complete that interview format.
• The Service uses artificial intelligence to evaluate your responses and generate your Molly rating. Ratings are used to assist assessment, and a human reviews outcomes before any decision that has a legal or similarly significant effect on you.
• Molly ratings are an estimate of demonstrated skill based on the information and responses you provide. They are not a guarantee of employment, and employers make their own independent hiring decisions.
• You agree not to attempt to manipulate, falsify, or game the assessment process, including by submitting work that is not your own or misrepresenting your identity or abilities.

4. Your content and licence to us

• You retain ownership of the content you submit to the Service, including your CV, profile information, and interview responses ("Your Content").
• You grant SmashTaps a worldwide, non-exclusive licence to host, store, process, reproduce, and use Your Content for the purpose of operating and providing the Service — including generating your Molly rating, matching you with opportunities, and, where you direct it, sharing your profile with employers.
• You represent that you have the right to submit Your Content and that it does not infringe the rights of others or violate any law.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose.
• Impersonate any person or misrepresent your identity, qualifications, or affiliation.
• Submit false, misleading, or plagiarised information or assessment responses.
• Upload malware, or attempt to disrupt, damage, or gain unauthorised access to the Service or its systems.
• Scrape, copy, or harvest data from the Service except as expressly permitted.
• Reverse-engineer, decompile, or attempt to extract the underlying models, algorithms, or source code of the Service.
• Use the Service to harass, discriminate against, or harm others.

We may suspend or terminate accounts that violate these Terms.

6. Intellectual property

• The Service, including its software, design, branding ("Molly"), and the AI models and rating methodology, is owned by SmashTaps and protected by intellectual property laws.
• Except for the rights expressly granted to you in these Terms, we grant you no rights in the Service.
• The Molly rating you receive is provided for your use in seeking employment. You may share it with employers, but you may not misrepresent it, alter it, or present it as issued by any party other than SmashTaps.

7. Third-party services and employers

• The Service integrates with third-party providers (for example, for authentication, recording, email, and calendar scheduling). Your use of those integrations may be subject to the third parties' own terms.
• When you apply to a job or share your profile, the receiving employer is responsible for its own use of your data and its own hiring decisions. We are not responsible for the acts or omissions of employers or other third parties.

8. Disclaimers

• The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Molly ratings will lead to any particular outcome, including employment.
• To the extent permitted by law, we disclaim all liability arising from your reliance on the Service or any rating.

9. Limitation of liability

To the maximum extent permitted by law:

• SmashTaps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or opportunities, arising out of or related to your use of the Service.
• SmashTaps's total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) USD 100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless SmashTaps and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

11. Termination

• You may stop using the Service and request deletion of your account at any time by contacting molly-support@smashtaps.com.
• We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service.
• Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Delaware, unless applicable mandatory law in your country of residence provides otherwise. Nothing in these Terms deprives you of the protection of mandatory consumer or data-protection laws in your place of residence.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
